Privacy Policy Effective: 04/25/2018 The Different and Able Foundation (the “Foundation”) Privacy Policy (the “Policy”) describes how the Foundation collects, uses, shares and protects information gathered through the Foundation’s website (the “Site”) or that is submitted to the Foundation when donations are made. The Foundation is committed to protecting your privacy. By using the Site, you agree to be legally bound by this Policy and the Terms and Conditions of Use, as amended from time to time. If you do not assent to this Policy or cannot form a legally binding contract, you are not permitted to use the Site. This Policy may also cover information collected and used by the Foundation via third party social media platforms, including Facebook, Instagram, Twitter and YouTube. Please note that the information provided on the Site is not intended as a substitute for professional medical advice and information. Information Collected The Site gathers two categories of information: (1) Non-Personal Information; and (2) Personal Information.
Non-Personal Information “Non-Personal Information” means information that does not specifically identify an individual person. Personal Information Personal Information We Collect. The Foundation also collects information that may be used to identify you (“Personal Information”). Personal Information collected by the Foundation may include your name, mailing address, telephone number, organization name, email address, credit card information, bank information and/or billing information. How We Collect This Information. This information is provided to the Foundation when you make a donation to the Foundation or voluntarily submit information to the Site (i.e., when you complete any of our Site’s forms, such as donation forms, volunteer registration forms, contact forms, newsletter registration forms and online surveys).
Use of Information Collected The Foundation uses the Non-Personal Information it collects to maintain and improve the Site, and may share Non-Personal Information with its business partners on an as-needed basis. The Foundation uses the Personal Information it collects for the purposes for which it was collected (for example, responding to your requests, contacting you via mail or email, sending newsletters, administering surveys or processing donations) and may share your Personal Information for the limited purposes set forth below.
Sharing of Information Information Made Public through Use of Our Site Certain features on the Site and the Foundation’s social media platforms give you an opportunity to interact with us and others. These features may include, without limitation, forums, message boards, chats, and creating community profiles. The Foundation will not exchange your Personal Information for a third party’s fundraising or marketing purposes if you opt out of allowing us to do so. Other than sales or exchanges of Personal Information for third-party fundraising or marketing purposes (as outlined above), the Foundation does not share, sell, transfer, exchange or disclose your Personal Information with third parties except in the following limited circumstances:● To carry out the Foundation’s mission (for example, we may share your Personal Information with third parties with whom we work, in order to accomplish the specific, limited purpose for which your Personal Information was collected, such as responding to your requests, contacting you via mail or email, sending newsletters, administering surveys or processing donations);● When you give us permission to disclose the Personal Information;● When changing website hosts or when our host transfers business assets (as further described under “Transfers of Business Assets” below);● When sharing your Personal Information with third party vendors, agents or contractors who perform services for us on a “need to know” basis (such as third parties who provide credit card, bank, payment and information processing services). Donor Disclosure Please note that the Foundation is obligated to disclose all donors.
Transfers of Business Assets At any time, the Site’s host may be acquired, merge with another business, or acquire or buy other businesses or assets. In such transactions, both Non-Personal Information and Personal Information will likely be among the transferred assets.
Cookies and Other Tracking Technology The Site may use cookies and other tracking mechanisms (e.g., web beacons and pixels) across our Site and social media platforms. Cookies allow the Foundation to measure activity on the Site and to improve your user experience by, for example, tracking and targeting your viewing preferences. Cookies do not collect, store or maintain any Personal Information. Although you may refuse, delete or turn off our cookies, this may create problems when using certain features on the Site.

Links The Site contains links to other sites (“Third-Party Sites”). Our Privacy Policy and privacy practices do not apply to Third-Party Sites. We encourage you to review the privacy policies and any other online policies of all Third-Party Sites.
Email This Policy does not apply to communications sent to the Foundation via email. If you wish to keep your communication private or confidential, do not use the Foundation’s email.
Children The Site does not seek to collect any information from children under age 13. If you are under age 13, do not send any information about yourself to us, including your name, address, telephone number or email address. If you are the parent or guardian of a child under age 13 who has sent us information, please notify us so that we may delete the information from our records.
Cross-Border Transfer Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using our Site, you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have different data protection rules than in your country.
